  • Porter Airlines Inc. agrees to pay $150,000 for allegedly violating Canada’s anti-spam law

Porter Airlines Inc. agrees to pay $150,000 for allegedly violating Canada’s anti-spam law

The Canadian Radio-television and Telecommunications Commission (CRTC) today announced that Porter Airlines Inc. has agreed to pay $150,000 as part of an undertaking for alleged violations of Canada’s anti-spam legislation. Once made aware of the investigation by the CRTC, Porter Airlines was cooperative and immediately took corrective actions to comply with the legislation.

    porter-racoon

An investigation launched by the CRTC’s Chief Compliance and Enforcement Officer alleged that Porter Airlines failed to comply with various requirements of the law between July 2014 and April 2015. The company allegedly sent some commercial emails that did not contain an unsubscribe mechanism. In other instances, it is alleged this mechanism was not clearly or prominently set out. Certain emails also allegedly did not provide the complete contact information as required by the law. Porter Airlines also allegedly failed to honour, within 10 business days, requests from some recipients to unsubscribe from receiving future commercial emails.

In addition, for certain emails sent between July 2014 and February 2015, the company was unable to provide proof that it had obtained consent for each electronic address that received its commercial emails.

As part of the undertaking, Porter Airlines will improve its existing compliance program to ensure that its activities, going forward, are fully compliant with Canada’s anti-spam legislation. The enhanced compliance program will include increased training and education for staff and improved corporate policies and procedures.

The CRTC is assessing complaints submitted to the Spam Reporting Centre that are under its mandate and a number of investigations are currently underway. The CRTC is working with its partners, both within Canada and internationally, to protect Canadians from online threats and contribute to a more secure online environment.

The CRTC can discuss corrective actions with individuals, firms or organizations, which may lead to an undertaking that includes an amount to be paid and other corrective measures. As part of its powers, the CRTC can also issue warning letters, preservation demands, notices to produce, restraining orders and notices of violation. Moreover, the CRTC can ask a court to issue a search warrant or an injunction.

Canadians are encouraged to report spam to the Spam Reporting Centre. To ensure the CRTC has enough information to conduct an investigation, the report should include the full email (including the message’s header) and a description of why the email is considered to be spam. Information sent to the Centre is used by the CRTC, the Competition Bureau, and the Office of the Privacy Commissioner to enforce Canada’s anti-spam legislation.

    Quick Facts

    • Porter Airlines has voluntarily entered into an undertaking with the CRTC’s Chief Compliance and Enforcement Officer for alleged non-compliance with Canada’s anti-spam legislation.
    • As part of the undertaking, Porter Airlines has agreed to make a $150,000 payment, comply with Canada‘ anti-spam legislation and improve its existing compliance program.
    • Porter Airlines allegedly sent some commercial emails that failed to comply with various requirements of Canada’s anti-spam legislation, including those relating to unsubscribe mechanisms, the provision of contact information and proof of consent.
    • Once made aware of the investigation by the CRTC, Porter Airlines immediately took steps to fully comply with the legislation.
    • To help businesses comply with the law, the CRTC has provided numerous information sessions across the country and made guidance materials available on its website.
    • The CRTC is working with its partners, both within Canada and internationally, to protect Canadians from online threats and contribute to a more secure online environment.
    • Canada’s anti-spam legislation protects Canadians while ensuring that businesses can continue to compete in the global marketplace.
    • Canada’s anti-spam legislation was adopted by Parliament in December 2010 and came into force on July 1, 2014.

    Quote

“We appreciate that Porter Airlines took corrective action once it became aware of our investigation. The company has voluntarily entered into an undertaking and committed to comply with Canada’s anti-spam law. This is a great outcome for Canadians, and we encourage them to continue to report suspected violations to the Spam Reporting Centre.

This case is an important reminder that to be fully compliant with the law, proof of consent is required for each electronic address. Some businesses are under the mistaken impression that they are compliant with the law by relying on general business practices or policies as proof of consent for the majority of the electronic addresses to which they send their commercial emails. This is simply not the case.”

  • W Seattle Hotel Review and Trip Report – Strange Mini Bar Item!

We love using our Avios to go from Victoria, BC to Seattle, WA for a nice long weekend – very walkable and always lots to do with kids.

We decided to splurge with some of our SPG points to redeem for a one night’s stay (10,000 points) at the W Seattle. It was a great location (close to Fairmont and 2 blocks from the light rail to get back to the airport and close enough downtown.

Some rooms come with city views and they all have flat-screen TVs, iPod docks.

The lobby is quite hip with a sushi bar, and a 3-story stainless steel fireplace topped with a DJ booth.

The W Seattle features Bliss toiletries which were really high quality (lemon and sage).

We all found minimal street and hallway noise.  The W Seattle was a peaceful stay but I thought overall that it was a good value for the points since I could pay about $150 on Priceline for a 4 star hotel to get something like the Pan Pacific or Marriott or the Hyatt Olive 8. Seattle is expensive for hotels (like most places on the west coast) so we enjoy any savings we can get.

It’s not a place for families with young kids, or at least I would not recommend it.  I found the halls very dark and didn’t have many little ones although they asked us if we wanted a crib (we never get one). If you have dogs, they will be able to accompany you with the hotel being pet friendly (which I don’t really care for).

They had fresh coffee and tea and water in the lounge all day (maybe because the film festival was happening).

One of the strange mini bar items was a pack of condoms!

This location is no more than a twenty minute walk to most attractions to explore in downtown Seattle.

  • American Express CENTURION Lounge San Francisco (SFO) Trip Report

I am a big American Express fan and as a holder of the Gold Rewards Card, Platinum Card, and Platinum AIR MILES card I expect some good perks when travelling.

On our latest trip overseas, we had a long layover at SFO, San Francisco, which is a great airport in the US (even has a yoga studio). Whomever complains about long layovers cry me a river (2 kids, 11 hours on route to Auckland).

If you are a Platinum Card or Centurion Member, access to The Centurion Lounge is complimentary as part of your Card Membership. This even works for Canadians so my family of 4 was in and it had so many amenities:

    Shower Suite

Refresh in our shower suite. This space is complete with plush towels and L’Occitane products, all for your rejuvenation.

    Kids and Parents Room

Area where kids can have fun and watch a movie or read or play! They had books even video games for older kids. It was a quiet place to relax and let the kids burn off energy. I kind of wish they had more books though – lots of comfy pillows.

We were there for 3 hours then left for a stroller nap and then returned to relax.

We enjoyed the fresh food and were able to relax before our 15 hour flight to Sydney.

I hope they add on of these lounges to Toronto or Vancouver!

  • American Express Membership Rewards 25% Transfer Bonus to British Airways Avios – Ends September 30, 2015

Through September 30, 2015, transfers from American Express Canada Membership Rewards Points to British Airways Avios will be at a 1:1.25 ratio.

    amex-transfer-bonus

This means instead of transferring 25,000 Reward Points you will get 31,250 – quite a nice savings.

With flights starting at just 4.5K Avios in coach and 9K Avios for a lie-flat business seat there are some real steals with Avios.

The 25% bonus that means that a coach award will start at just 3,600 Membership Rewards Points and a Business award will start at 7,200 Membership Rewards Points.

This is great news for us Canadians as the US program has a 1000:800 ratio coming up in October.

Avios is the loyalty program for British Airways. This airline flies from Vancouver, Calgary, Edmonton, Toronto, Montreal to cities in Europe. Additionally, they have a code-share with WestJet that lets you earn Avios.

One major benefit of the Avios program is that you can combine Avios points from different Avios schemes (British Airways) into one family member’s accounts. This can make it easier to redeem your acquired points.

The Avios program works on distance, so you can find some great buys.  A one-way flight between Toronto and New York can be had for only 4,500 Avios points (9,000 round trip), compared to 15,000 Aeroplan Miles for the same flight (round-trip).

Here are some good value redemptions with Avios:

    • Vancouver, BC (YVR) to Los Angeles, CA (LAX), 15,000 Avios
    • Toronto, ON (YYZ) to Miami, FL (MIA), 20,000 Avios
    • Victoria, BC (YYJ) to Seattle, WA (SEA), 9,000 Avios
    • Calgary, AB (YYC) to Dallas, TX (DFW) 20,000 Avios
    • Edmonton, AB (YEG) to Seattle, WA (SEA) 9,000 Avios

Even a trip to Hawaii from Seattle is only 25,000 Avios round-trip!

    Positives:

    • No blackout dates for redemption.
    • Can create a Household Account that enables you to share your Avios with the other members of your household for free.
    • Fantastic redemptions with Avios on short-haul flights (Montreal or Toronto to New York or Chicago, Calgary or Edmonton to Seattle) using American Airlines or Alaska Airlines (9,000 round trip).
    • The taxes are next to nothing (except for standard airport fees).

    Negatives:

    • No retail partners in Canada to earn extra Avios.
    • Charged for extra stopovers as an additional flight.
    • Major fuel surcharges charges.

One of easiest ways to earn Membership Reward Points with very little cost is the Gold Rewards Card (comes with 25,000 free bonus miles after spending $500 the first 3 months).

  • Madame Tussauds Wax Museum in Sydney Australia Review

I am a big fan of wax museums. I always have fun and learn a few different things while visiting.

We had the chance to visit the Madame Tussauds Wax Museum in Sydney Australia on a trip this past winter. I went with the whole family as I feel this is a good family activity to do.

We did the entire exhibit in about 1 hour. I thought it was kind of short compared to other wax museums I have been to before (even the defunct one in Victoria, BC).

Hanging out with the Royal Family!
Hanging out with the Royal Family!

One of the things I like about a wax museum vs a regular museum is that they have these fun props where you can dress up next to the statues and have some fun!

They had many Aussie actors and celebs (Nicole Kidman, Russell Crowe, the various cricket stars I had no idea who they were), so it was a lot of fun to see some different statues. They do an amazing job making them look authentic.

I recommend paying for the pass to see multiple attractions (Skywalk, aquarium, etc) for one low price as this one attraction’s price may be too high for some larger families.

  • Westin Wall Centre, Vancouver Airport Trip Report

I have had the pleasure of staying at the Westin Wall Centre, Vancouver Airport (YVR) many times. It is one of my favourite hotels in Vancouver.

It is located close to YVR with a free shuttle, you have a great lounge to watch planes land, close to River Rock Casino and the Canada Line to get downtown, a nice pool and workout area.

Most important, a comfortable bed and large enough rooms to relax in.

My favourite part was the pool with no one there!

I recommend staying here if you are trying to preserve your Starwood balance. I use only 7,000 points per night (you can get 20,000 points with one credit card signup).

They are also very kid-friendly, both of my daughters received a little package as a thank-you and were entertained!

    Westin Kids Club.

It is easy enough to get to downtown with the Canada Line and there is free street parking if you don’t want to pay the hotel’s parking fees (this is what we do when we come to the mainland).

Remember that hotels in downtown Vancouver can be quite noisy and you will want to have a car to see many sights outside the City Center so that is why I always recommend this hotel.

It is a steal at only 7,000 SPG points and I have stayed there five times and have always enjoyed it!

  • WestJet announces service to London Gatwick

WestJet announced it has selected London, England as the first transatlantic destination from Canada for its wide-body Boeing 767-300 aircraft. Service from Canada to London will be through London Gatwick.

    westjet-boeing-767-300-March5

“This news marks the next phase in the international portion of our strategic plan,” said Bob Cummings, WestJet Executive Vice-President, Commercial. “WestJet is at the right scale to make this step in our evolution. Combined with our low-cost approach and renowned people-driven service, we have the network, brand and infrastructure to successfully enter and grow in the wide-body market. We look forward to announcing, later this summer, our entire schedule and low-fare approach for the spring of 2016.”

“Wide-body capability now allows us to serve London Gatwick from anywhere in Canada and brings into consideration more international destinations in the future. The Canadian cities we will fly from will be determined over the course of this summer,” continued Bob Cummings. “We will meet with airports across the country to determine the most suitable ones we believe will meet our needs and those of our guests.”

Further announcements on schedules, pricing and launch cities will be communicated later this summer with service commencing in spring 2016.

Where do you think they will have flights from? I hope not St. Johns!
